1. Service Provider Details

These General Terms and Conditions (GTC) govern the legal relationship between the Service Provider and users/customers using the services available on https://danube-flow.com and its subdomains.

2. Basic Provisions

2.1. Issues not regulated in these Rules and the interpretation of these Rules shall be governed by Hungarian law, in particular with regard to the relevant provisions of Act V of 2013 on the Civil Code ("Civil Code"), Act CVIII of 2001 on certain issues of electronic commerce services and information society services ("Act on Electronic Commerce"), and Government Decree No. 45/2014 (XI. 26.) on the detailed rules of contracts between consumers and businesses. The mandatory provisions of the relevant legislation shall apply to the parties without any specific stipulation.

2.2. These Rules shall enter into force upon publication on the website https://danube-flow.com and shall remain in force until revoked. The Service Provider shall be entitled to unilaterally amend the Regulations (circumstances giving rise to amendment: changes in legislation, business interests, operational modifications). The Service Provider shall publish amendments on the website 11 (eleven) days before they enter into force, during which period the User shall be entitled to withdraw from or terminate the contract. By using the website, Users agree that all regulations relating to their use of the website shall automatically apply to them.

2.3. The Service Provider shall be entitled to unilaterally amend these Regulations due to changes in legislation, official regulations, or technical and operational requirements. The Service Provider shall publish amendments on the website 15 (fifteen) days before they enter into force. Such amendments shall not affect contracts already concluded and confirmed prior to the publication, which shall be governed by the terms in force at the time of purchase.

3. Range of Products/Services Available for Purchase, Price Indication, Incorrect Price

3.1. Prices displayed for passenger transport services and tickets are in EUR (or HUF, where applicable) and include VAT as required by law.

3.2. On the website, the Service Provider provides details regarding the name, type, schedule, and description of the passenger transport service or ticket.

3.3. If a promotional price is introduced, the Service Provider will fully inform Users about the promotion and its exact duration on the website.

3.4. If the Service Provider, despite all due care, displays an incorrect price on the website interface—in particular a clearly incorrect price (e.g. "0" EUR/HUF or "1" EUR/HUF price that differs significantly from the well-known, generally accepted, or estimated price of the ticket, or due to a system error) —the Service Provider is not obliged to confirm the order at the incorrect price. Instead, it may reject the offer and offer to confirm the correct price, in the knowledge of which the Customer may withdraw from the purchase. An incorrect price is defined as a clearly and layout-wise erroneous, disproportionate price (e.g. '0' EUR/HUF or '1' EUR/HUF) that is obviously displayed as a result of a technical system error or data entry slip, and which differs fundamentally and noticeably from the generally accepted market price of the service.

3.5. In the event of a noticeable discrepancy between the actual and indicated price of the ticket, the contract shall be concluded only by mutual and unanimous expression of the will of the parties in accordance with Act V of 2013 on the Civil Code. If the parties cannot agree on the contractual terms, no valid contract is created.

4. How to Order and Payment

4.1. The User can start purchasing tickets without registration.

4.2. The User selects the appropriate available date, cruise/trip, and type of ticket/deck by clicking on the appropriate ordering/ticket button.

4.3. The User sets the desired quantity of tickets.

4.4. Payment Methods:

  • Online Payment by Credit/Debit Card: The User has the possibility to pay the total amount of the order online via credit/debit card through the secure online payment gateway operated by Wix.com or their financial partner

  • Payment for tickets can only be made electronically (online) as part of the order process. The transaction is processed as a bank card purchase, and related fees (if any) are charged according to the customer's bank tariffs.

  • The User must enter the required card details (card number, cardholder name, expiry date, CVV2/CVC2 code) on the payment gateway interface. Acceptance of specific card brands (VISA, Mastercard, Maestro, AMEX) is determined by the payment gateway provider.

  • Upon successful or unsuccessful payment, the User is redirected back to the Service Provider's website with a confirmation status. Technical errors during payment processing do not constitute a completed purchase.

4.5. Shipping Cost: Digital delivery of electronic tickets carries no shipping cost.

4.6. Correction of Data Entry Errors: Before sending the order, the User can verify and modify the entered data at any point during the purchasing process.

4.7. By placing an order, the User explicitly acknowledges that a payment obligation arises.

4.8. Invoices are issued and sent electronically by the Service Provider to the e-mail address provided by the User.

5. Processing and Fulfilling Orders

5.1. Order processing is automated and ongoing.

5.2. Fulfillment Date: According to the specific date and time selected on the purchased ticket.

5.3. Based on the contract, the Service Provider is obliged to provide the specified inland passenger water transport service, and the User is obliged to pay the purchase price and present the valid ticket for boarding.

5.4. If the Service Provider cannot fulfill the service due to unavailability or technical reasons, it shall immediately inform the User and refund the total amount paid without delay.

6. Right of Withdrawal and Cancellation Conditions

6.1. Pursuant to Directive 2011/83/EU of the European Parliament and of the Council and Government Decree 45/2014 (XI. 26.) Section 29 (1) l), the consumer does not have a statutory right of withdrawal or cancellation after purchase, as the services provided (scheduled boat cruises and specific-date vessel rentals) constitute leisure activities stipulated for a specific performance date. All refunds or modifications are subject exclusively to the voluntary cancellation policy detailed in Section 6.4.

6.2. Service Provider Cancellation / Refunds: The Service Provider may refund the price of the ticket if the service cannot be carried out due to:

  • Adverse weather conditions, high or low water levels, or official navigational bans/restrictions issued by competent authorities making navigation unsafe or legally impossible;

  • Technical reasons preventing vessel operation;

  • Force majeure or unforeseen events affecting safety or operational feasibility.

6.3. The Consumer is not entitled to a refund if they arrive late and miss the scheduled departure.

6.4. Voluntary Modification and Cancellation Policy of Danube Vibes Kft.:

  • Ticket Modification: Free of charge if requested at least 12 hours prior to departure. No modifications are possible within 3 hours of departure.

  • Ticket Cancellation:

    • 24 hours or more prior to departure: Full refund or gift voucher valid for 1 year (as requested).

    • Within 24 hours of departure or no-show: No refund or voucher shall be issued

  • Requests for modification or cancellation must be sent in writing from the e-mail address associated with the order to office@danube-flow.com, including the booking reference or ticket number.

  • Vouchers or tickets purchased via third-party platforms (e.g., GetYourGuide, Viator) can only be modified or cancelled through the respective third-party platform.
     

7. Warranty and Liability

7.1. In the event of defective performance by the Service Provider, the User may assert warranty claims in accordance with the provisions of the Hungarian Civil Code (Act V of 2013).

7.2. The User (if acting as a consumer) must report any defect immediately upon discovery, but no later than within two months of discovery. Limitation periods apply in accordance with statutory regulations (2 years for consumers, 1 year for business entities).

8. Procedure in Event of Warranty Claims (Consumers)

8.1. The consumer must present proof of contract conclusion (e.g., electronic ticket confirmation or invoice).

8.2. The Service Provider shall keep minutes of any warranty or complaint claims notified by consumers and retain them for 3 years.

9. Miscellaneous Provisions

9.1. The Service Provider may engage subcontractors or intermediaries to fulfill its obligations and shall remain responsible for their conduct.

9.2. Should any provision of these GTC be deemed invalid or unenforceable, the validity of the remaining provisions shall remain unaffected.

9.3. Applicable Law and Jurisdiction: Governing law is Hungarian law. Consumer disputes are subject to the competent courts of the consumer's domicile or statutory rules of jurisdiction.

9.4. Compliance: The Service Provider complies with Regulation (EU) 2018/302 on addressing unjustified geo-blocking and other forms of discrimination within the internal market.

10. Boarding Conditions
  1. Passengers are required to arrive at the designated boarding point at least 15 minutes prior to the scheduled departure time. Boarding gates close 3 minutes before departure. Late arrival shall be treated as a no-show under Section 6.3.

  2. The ticket must be issued in the passenger's name or valid booking reference.

  3. The passenger must present a valid photo ID upon request at boarding.

  4. The name on the ticket must match the identification provided.

  5. If conditions are not met, the Service Provider reserves the right to deny boarding without refund.

  6. In case of justified suspicion of fraudulent electronic transactions, the Service Provider reserves the right to request proof of identity matching the billing details. If the customer refuses to cooperate, the Service Provider may notify the payment gateway provider or the competent authorities.

  7. The Service Provider reserves the right to deny boarding without any refund if the passenger appears severely intoxicated, under the influence of drugs, displays aggressive or disorderly behavior, or if their hygiene or appearance poses a risk to the health, safety, or comfort of other passengers and the crew.
     

11. Passenger Obligations On Board

11.1. Passengers explicitly acknowledge that operating a vessel on public waterways constitutes a hazardous operation (fokozott veszéllyel járó tevékenység). Passengers board and remain on the vessel at their own risk, and are required to exercise heightened caution regarding the natural movements of the ship (e.g. waves, rocking) and potentially slippery surfaces.

11.2. By boarding the vessel, Passengers automatically accept as binding all safety regulations, onboard rules, and instructions issued by the captain and crew.

11.3. Failure to comply with safety regulations or crew instructions may result in denial of further service or disembarkation at the nearest port without compensation.

11.4. The Service Provider excludes all liability for any loss, theft, or damage to personal belongings, luggage, or electronic devices brought on board by passengers, including items falling into the water, unless the damage is a direct result of the Service Provider's gross negligence or willful misconduct.

11.5. Passengers shall be held fully financially liable for any damages caused intentionally or by negligence to the vessel, its interior, fixtures, furniture, or safety equipment (including the unjustified activation of life jackets or safety devices). The Service Provider reserves the right to charge the customer for all repair and cleaning costs.

11.6. Bringing outside food and beverages on board is strictly prohibited. Animals/pets (except for certified service dogs) are not allowed on board without prior written consent from the Service Provider.
11.7. Strollers and wheelchairs are subject to vessel capacity and safety restrictions. Passengers requiring step-free access are advised to contact the Service Provider before booking, as certain boarding points may not be fully wheelchair accessible due to changing water levels.

11.8. Jumping, diving, or swimming from the vessel into the river is strictly prohibited at all times. Any violation of this rule shall result in immediate termination of the service for the passenger without refund, and the passenger shall be held fully liable for all resulting official fines, rescue operation costs, and damages caused to the Service Provider.

12. Complaints Handling Policy

12.1. Complaints may be submitted in writing to office@danube-flow.com or sent to the registered seat address: 1142 Budapest, Kacsóh Pongrác út 123. 1. em. 5. ajtó

12.2. The Service Provider shall investigate the written complaint and notify the Customer of its reasoned position in writing within 30 (thirty) days from the receipt of the complaint.

12.3. Consumer Protection Authorities and Conciliation Bodies:

Consumer Protection Authorities and Conciliation Bodies: In the event of an unresolved dispute, consumers may contact the competent Regional Conciliation Board. The territorially competent body for the Service Provider's registered seat is the Budapest Conciliation Board (Budapesti Békéltető Testület; address: 1016 Budapest, Krisztina krt. 99., e-mail: bekelteto.testulet@bkik.hu). Pursuant to Hungarian law, the Service Provider is subject to a mandatory cooperation and binding decision obligation in conciliation board proceedings if the consumer's claim does not exceed HUF 200,000.:

13. Copyrights

13.1. All content on https://danube-flow.com is protected by copyright. Reproduction, public retransmission, or unauthorized commercial distribution without written consent from Danube Vibes Kft. is strictly prohibited.

14. Data Protection

14.1. The Service Provider processes personal data in strict compliance with Regulation (EU) 2016/679 (GDPR) and applicable national data protection laws. The detailed rules, purposes, legal bases, and data subject rights regarding data processing are set forth in the Service Provider’s Privacy Policy, which is permanently accessible via danube-flow.com. By accepting these General Terms and Conditions, the Customer explicitly acknowledges that they have read and understood the terms of the Privacy Policy.

15. Data Transfer Declaration

15.1. The User acknowledges that personal data stored by Danube Vibes Korlátolt Felelősségű Társaság (1142 Budapest, Kacsóh Pongrác út 123. 1. em. 5. ajtó) in the user database of https://danube-flow.com may be transferred to designated data processors (e.g., payment gateway operators, ticketing platforms such as FareHarbor or GetYourGuide). Transferred data may include: name, e-mail address, billing address, and transaction details.
